WAIVER AND RELEASE AGREEMENT- Effective January 1, 2026-January 1, 2027

This is a release of liability and waiver of certain legal rights.
In consideration, for my being permitted to participate in the activities of Snows Unlimited, I agree to the following Waiver and Release:
I acknowledge and fully understand that shooting a gun, climbing into a goose pit or duck blind, using an ATV or UTV, even walking on any Snows Unlimited leased property has inherent risk hazards, and danger. I understand that these risks, hazards, and dangers include without limitation:

• The risk of handling firearms and being near others that have firearms in their possession.
• The risk of injury from ammunition and shot from other guns.
• The risk of walking in rugged country, including encounters with wildlife, animals, and insects.
• The risk of inclement weather conditions.
• The risk of injury from riding on an all-terrain vehicle, Utility-type vehicle, or any vehicle used off the paved road.
• The risk of injury from onto or leaving from highway onto or out of the parking lot.
• The risk of slipping on ice or falling through ice while on any Snows Unlimited lease property.
• The risk of climbing in or out of the goose/duck blinds.

I understand the risks, hazards, and dangers as described above and have the opportunity to discuss them with James Frerking. I believe that I am in good physical condition and have adequate skills and knowledge necessary for me to engage in these activities safely. My participation in any of the activities at Snows Unlimited is purely voluntary. No one is forcing me to participate, and I elect to participate in spite of the risks. I AM VOLUNTARY USING THE SERVICES OF SNOWS UNLIMITED WITH FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS, AND DANGERS INVOLVED AND HEREBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, PARALYSIS, OR DEATH. IMPORTANT NOTICE: Please be aware that anything that you post on Facebook, Twitter, or any other chat forum or social media platform, we, Snows Unlimited, have the right to seek legal advice with slander and defamation lawsuits. We provide you with a place to hunt. There are no refunds or guarantees. COMPLIANCE WITH WILDLIFE LAWS: All participants are required to adhere to all applicable state and federal wildlife regulations, including but not limited to the Lacey Act. This includes ensuring that any game harvested and transported across any state lines is done so in full compliance with all legal requirements.
Lastly, I for myself, my heirs, executers, and subrogates, hereby knowingly and intentionally waive and release indemnify and hold harmless all or each James Frerking, guides, directors, officers, agents, employees, volunteers, lessors, landowners, and Snows Unlimited, from and against any and all claims, actions, causes of action, liabilities, suits, expenses including reasonable attorney’s fee which are related to, arise out of, or are in any way connected with my participation in this activity including, but not limited to, negligence of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, Loss injury, paralysis, or death to me or my leased property as a result of my engaging in these activities or the use of these services, animals or equipment whether such damage, loss, injury, paralysis or death results from negligence of James Frerking or from some other cause. I for myself, my heirs, my successors, executors and surrogates, further agree not to sue James Frerking or their agents, employees, visitors, landowners, lessors, or Snows Unlimited because of any injury, paralysis, or death suffered in connection with my use and participation in the activities of Snows Unlimited.
I HAVE CAREFULLY READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT DO AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE JAMES FRERKING DBA SNOWS UNLIMITED, FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE OR INJURY.
